Colorado Springs area home prices are up over 2009

Believe it or not, prices on real estate have moved up in the last year.

Looking at trends in the Colorado Springs Real Estate Market including: Monument, Palmer Lake, Stetson Hills, Fountain/Ft. Carson, a few things are obvious.

1) Prices have trended upwards since December 2009

2) Inventory levels are decreasing to the 7-8 months range, moving closer to the 6 mos. level which represents market equilibrium.

3) Foreclosure reporting is down 13%

Every market across the country is different. These stats for the Colorado Springs area indicate that a foothold has been reached and market stabilization is here. This coupled with interest rates in the mid-to high 3% range make qualifying for more home possible.

The $175,000 to $250,000 segment of the market is the most active. However there is a spike in activity in the $300,000 to $450,000 ranges are seeing increased activity due to lower rates making these homes more affordable.

Lack of Credit Extension Would Dash Hopes of Home Buyers in All 50 States

Up to 180,000 home buyers will lose their tax credit through no fault of their own if Congress fails to pass an extension to the home buyer tax credit by June 30 when the closing deadline expires. Included in that number are thousands of home buyers in every state of the union, from 390 in Wyoming to 17,700 in California, according to estimates by the National Association of Realtors®.

“We are strongly urging the Senate and the House to act quickly to pass this legislation and ease the minds and pocketbooks of these home buyers,” said NAR President Vicki Cox Golder, owner of Vicki L. Cox & Associates in Tucson, Ariz.

“These are not buyers who just entered into the market. These are buyers who previously met all the qualifications for the tax credit, but find themselves at the mercy of a workflow jam with lenders or other delays such as lapses in the National Flood Insurance Program, Rural Housing Service, and new home construction, and might not be able to complete the purchase of their homes by the current deadline,” said Golder. “It would be a tragedy for them not to be able to complete the purchase in time to claim the credit.”

NAR issued the following state-by-state estimate of the number of home sales that would be delayed beyond the June 30 deadline; numbers are rounded to the nearest 10:

Not so fast. Extension of tax credit fails! June 30 Deadline stands.

If you were counting on the Tax Credit Deadline being extended, your luck may have run out. The extention, which was tied to other legislation, falied to get the votes necessary to push the deadline back allowing those transactions (Mostly short sales) to close.

If you were under contract by April 30 and hoping to benefit from credit, you should call your lender and realtor TODAY to see what, if anything can be done to facilitate a closiing by June 30.

If you are planning to close on your property, and are able to do so, be sure to schedule your closing ASAP. Local lenders and title companies are sure to be scrambling to prepare necessary documents to beat the deadline. Available closing times may be tough to get in the next few days.

BEWARE The Rules of "Short Sale" game may be changing!

It's interesting how the landscape changes in real estate. Often times you can see it happening before most folks realize what's going on. That's why so many got hung out to dry when they bought in '05, '06 and '07 and are now trying to sell being upside down.

Rencently, I have noticed another trend that may impact short sales. I am not sure if the banks are predicting an increase in prices or something else, but is seems like in more instances they are much less likely to negotiate or their terms are more restrictive when negotiating their short sales.

I have seen a few "Uncommon" examples of this recently where lenders are asking those short selling their properties to sign a deficiency note for the balance owed before they will approve the sale. Also I have seen banks, while in the counterproposal process, actually increase their counter above asking price.

While not the norm today, usually we see a few examples of these practices before they become common. These examples become more frequent until they are the rule.

Why is this important? Because, if you are considering a short sale, knowing what lies ahead is important. I believe that if you are looking at a home that is a short sale, you should expect that the bank may not approve the sale. A far change from months past where virtually all short sales were approved.

Don't leave yourself exposed by becoming too attached to a home before you get final approval from the bank who is approving the sale. Give yourself a few options and consider your "Plan B". The dissapointment you save will be your own.

For those of you that have not heard….Congress extends First Time Home Buyer Tax Credit deadline to September 30th

The National Association of Realtors beat their drums loudly enough on the steps of Capital Hill to get Congress to approve an extension of the First Time Homebuyer Tax Credit.

The tax credit extension is only for those who were already under contract before the previous deadline of April 30th, they now have until September 30th to close and receive the $8000 first time buyer credit. This extension is from a close date of June 30th.

The most compelling reason for this extension was do to the high volume of Short Sales that are currently under contract and are not on scheduled to close by the June 30th date. This is because Short Sales require bank approval on the Seller's side, and most large banks that are being asked to approve Short Sales are simply over inundated with such requests that they are just backed up.

Mortgage interest rates drop again this week, which is in direct contrast to where most industry experts believe they are headed.

Today's rate is averaging 4.82% on a 30yr fixed rate mortgage according to Bankrate.com. This is down from last weeks average of 4.91%.

If you are planning to buy, and the cost of money is important to you, do not hesitate. There are plenty of fair valued homes on the market which should provide for a solid long term investment. Act now because by the end of the year, these rates will be gone!

Forecasters see full real estate recovery by 2013

In speaking with buyers in today's Colorado Springs Real Estate market, the most important question I ask is how long is the investment period. Meaning how long do they plan in staying in their home.

Even though this is a loaded question, the answer is important to determining what is the right option for them. If I get an answer that tells me that it is a short term investment, I do recommend that they carefully evaluate their situation further to determine what the outcome will be if they do not realize a return.

Certainly I believe that values will increase...in the longer term. I also believe that there is real risk in realizing gain in the short term.

Yet another example of when the Colorado Springs real estate market will recover is found in the Inman News article dated July 7, 2010. As mentioned in the article, there are a number of factors playing into the time expected for full recovery.

On the other hand if the hold period is longer, say 3-5 years or more, the stars have aligned and are producing some terrific opportunities: Low prices and all time low rates. If you fit into this category, buying now in Colorado Springs will, in my opinion, prove to be a good move looking back.

Real estate has always proven to be a solid investment. This time around will prove to be no different except that we now nave deflated values and low rates to which we can leverage future benefits. If you plan to stay in the area, go ahead and buy now, you will be paying rent anyway.

The Ying and the Yang of Mortgage Interest Rates

Ok, so I have been preaching how rates are expected to go up by year end. In-fact, I think I may have even predicted rates over 6% by year end.

With that being said, I find myself amazed that today's 30 yr fixed rate mortgage according to, FreeRateUpdate.com, is 4.5% for well qualified buyers. So what gives?

In my opinion I do believe that rates are going to increase. There are too many economic factors in play for that NOT to happen. However we are presented with a fabulous gift RIGHT NOW! The gift of affordability.

As many professionals agree, every 1% increase in rates leads to a 10% decrease in affordability. This means that if you can afford a $200,000 home at today's rate, when rates jump 1% you will only be able to afford approximately $180,000. Combine this with lower home prices and you have a pretty good mix of rates and prices working to your advantage.

I do agree that there is a lot of anticipation regarding Colorado Springs real estate values in the short term. Speculation about national economic issues do have many people nervous about the future. With that in mind, a short term investment in real estate may not be the best strategy. However, if your game plan is to buy-and-hold for the longer term, you may be looking in the rear view mirror a few years from now wishing you would have capitalized on this opportunity.

Applying for mortgage? Starting June 1, you could face another credit screening

If you're thinking about applying for a home mortgage, here's some important news: Beginning June 1, your lender is likely to order a second full credit screening immediately before closing.
The last-minute credit report will be designed to find out whether you have obtained -- or even shopped for -- new debt between the date of your loan application and the closing. If you've made applications for credit of any type -- for furnishings and appliances for the new house, a car, landscaping, a home equity line, a new credit card, you name it -- the closing could be put on hold pending additional research by the lender.
If you've actually taken out new loans that are sizable enough to affect the debt-to-income ratio calculations used in your original mortgage approval, the whole deal could fall through. The added debt load could render you ineligible for the mortgage because you suddenly appear unable to handle the payments without a strain on your household budget.
The June 1 changes are part of a new effort by mortgage giant Fannie Mae to cut down on slipshod underwriting by lenders and fraud by borrowers. Fannie's "loan quality initiative" will require lenders not only to pull two credit reports for each mortgage transaction but to perform additional verifications of borrower occupancy plans for the property, Social Security numbers and Individual Taxpayer Identification Numbers.
"There's an almost irresistible urge" for many mortgage borrowers, said Don Unger, chief executive of Advantage Credit of Evergreen, Colo. "The lender says, 'Okay, you're approved for the loan,' and you immediately think about shopping for all the things you need for the house. You go to Home Depot" or other major retailers, "and you put in an application."
In the past, that might not have raised an eyebrow -- or even been detected. But under the new double-check policy, when the Home Depot application shows up as a "hard," or borrower-initiated, inquiry on a credit report, Unger said, the lender "is going to have to contact" the merchant and determine whether credit was extended, in what amount, and how this might affect the applicant's home financing transaction.
Marc Savitt, president of the National Association of Independent Housing Professionals and a mortgage broker in Martinsburg, W.Va., said it's not an uncommon scenario. "Most often the new debt involves furniture or other goods for the house," Savitt said. "However, we have seen debt for new cars and other major purchases."
Terry Clemans, executive director of the National Credit Reporting Association, recalls one case in which the home buyers "went out and gorged on $40,000 worth of new furniture and all types of stuff" after their loan approval -- incurring monthly payments far beyond what they could possibly afford. Under the new policy, they would likely be shot down before closing.
Fannie Mae spokeswoman Janis Smith said lenders "will have to look for things like new credit accounts, increased credit lines, increased balances on existing accounts, undisclosed or newly recorded liens, second mortgages -- anything that may have changed since initial application that might impact a borrower's debt-to-income ratio."
As a practical matter, some lenders are likely to ask their credit reporting vendors to perform the actual investigations when new debts or inquiries pop up on borrowers' files. Fannie Mae's instructions say that "lenders must determine that all debts of the borrower incurred or closed up to and concurrent with the closing" are considered in the final loan analysis.
Unger, however, said all this may not be as straightforward as it sounds. For example, if the credit report is pulled immediately before closing to comply with the "up to and concurrent" requirement, there may not be sufficient time to check out inquiries -- especially those in which no actual drawdown of debt has been reported to the national credit bureaus. He also questioned whether entire loan packages might need to be re-underwritten -- a time-consuming process -- based on credit data discovered at the eleventh hour.
In that event, poof goes your closing.
How should home buyers and refinancers prepare for the new credit check procedures? Lenders and credit reporting company executives say everybody needs to follow just one basic rule: abstinence. Between your application for a mortgage and the date of closing -- which might be a span of 45 to 60 days or more -- resist the irresistible.
Don't apply for new credit unless you discuss it in advance with your lender and get a green light.

Personally speaking Colorado Springs is a beautiful place to live. With plenty of activities throughout the year, I don't have to look far for entertainment. Changing seasons provide for year around beauty.

Professionally speaking, Colorado Springs has been a great place for business. Although we do feel the impact of recent economic times, by no means have we seen the massive swings witnessed in other states. Sure challenges are everywhere with Colorado Springs being no different but it seems the pendulum does not swing as far to either side.

In fact, Forbes.com has ranked Colorado Springs #12 nationally for Best Places and Careers on April 10, 2010.

Buy a home...the way they used to!

Interesting enough, I have been in and around the real estate business all of my life. From the time I was a kid, my Father sold real estate. In fact he worked in the same office as Tom Hopkins, the Real Estate Trainer who made his mark by selling in a band uniform.

Back in "The day", I remember my Father telling me about houses and that if you wanted to buy one, you needed 20% down. Putting money down was the norm. Part of the American Dream was saving the money for a down payment and the pride associated with that.

Contrast this to the last few decades where 100% financing is the trend. Easy credit was everywhere. No-doc loans, quite popular until a few years ago, enabled perspective home buyers to simply state the income they made with no supporting documentation. Another extinct loan package was the 80/20, yet one more way to buy a home with no money down. Is it any surprise that we see the many distressed sales on the market recently?

Certainly there are many examples of how easy credit has manifested itself upon our economy. Credit cards, car loans, home equity lines of credit and yes home mortgages have all been used excessively. Now the chickens have come home to roost. Our current economy is a result of debt accumulation and over-financing of years past.

Looking forward, I expect Colorado Springs real estate will improve....over time. Although we have seen some bright spots recently, there is also the potential for bumpy roads in the short term. Additionally my belief is that, once past these rough times, we will be better for them. Lessons will be learned about finances and use of credit and we will become more accountable to ourselves to live within our means. As a result, Colorado Springs real estate and national markets alike will be based upon solid, sustainable growth which will provide more reliability in the investment of real estate.

By no means would I ever discourage home ownership. In years past owning real estate was among the top vehicles for accumulating wealth. I see no reason for that trend not to continue in the long term. When purchasing a home now or in the future, my recommendation is to buy it the way they used to. Keeping a few "Old fashion" values in mind will dramaticly improve your position: 1) Put a large amount down. 10% or more. 2) Be debt free. Get rid of credit cards and car payments. 3) Go for shorter term mortgages. Look into the possibility of a 15 year vs a 30 year mortgage. 4) Maintain a lower debt to income ratio. Is would be wise to buy less home than you can afford. Save the stress on yourself and your wallet with a lower payment than which you qualify. You will be happier for it!

Real Estate Markets Send Mixed Message

Back to the same old mixed messages seems to be the norm. According to an article "Real Estate Outlook: Mixed Message" by Kenneth R. Harney as seen on Realty Times on May 24, 2010 we are seeing a mixed bag:

1) Housing starts are up meaning that the number of homes currently under construction are up.

2) The number of newly initiated building permits is down.

3) New applications for mortgages was sharply down from last week.

4) Home prices in most markets are rising

It seems that the homebuyer's tax credit did create additional demand for homes thereby prompting a short term increase in prices. However builders and lenders are seeing the expected "Post Tax Credit" decrease in home sales and mortgage applications.

So what of the summer selliing season for real estate in Colorado Springs. Professionally speaking we still have a number of challenges, like the rest of the country: High unemployment numbers, uncertainty in the political landscape, volatile financial markets and spiraling national debt.

The most effective way, I have found, to determine what to expect in the market is through blogs and talking to many perspective home buyers and sellers. It seems futile to predict the future by looking at the past numbers. Sure there is seasonally adjusted numbers that can be expected in the Colorado Springs real estate market but that is where it ends. The erratic shifts we see today give us no concrete trend in which we can forecast longer-term future prices.

In short we do not know where we are headed in the short term. It seems to be day-to-day with lots of specultion. My recommendation: whatever your real estate goals are, execute them based on today's reality. Predicting a future move based on speculation will have the propensity to produce a less than desired result.

Colorado Ranks Below National Average for Foreclosure Rates

On a national scale, the Colorado Springs Real Estate market ranks just below the national average on foreclosure rates.

According to Realtytrac, the state of Colorado is seeing rates that were 1 out of every 337 homes in the foreclosure in the month of April. Locally, El Paso County, the rate is 1 in 311 and Colorado Springs is 1 in 372: just above the state average and just below national average

Compare that nationally and you get a better picture. Leading the nation is Nevada with 1 in 69, Arizona is 1 in 169 and California is 1 in 192. On the lower side you have states like Texas with a rate of 1 in 730, Kansas 1 in 1349 and Wyoming 1 in 4739. The national range is between 1 in 69 (Nevada) to 1 in 26,056 (Vermont). The national average is 1 in 386.

"Shadow Inventory" May Impact Future Real Estate Prices

Shadow Inventory includes all delinquent loans, not just those that are currently REOs.

According to an article written by S&P (Standard andPoor's) on February 16, 2010, a conservative estimated time to reduce this inventory may take almost 3 years at the current rate of liquidation. Cited reasons for this are weak economic environment, distressed residential home values, and the resulting contraction in the supply of mortgage finance.

Up until now the inventory liquidation has been constricted for a variety of reasons leading to increasing levels of Shadow Inventory. A shift in loan servicer's strategies to expedite the reduction of their troubles assets may lead to a higher level of distressed homes for sale in the future, says the article.

Although the potential exists for short term negative impact on prices, recent data provides some hope for recovery of the housing market. The number delinquent loans seen each month seems to have peaked.

The silver lining in these predictions may be found in the impacted markets. While Arizona, Nevada, Califorinia and other states have seen higher rates of foreclosures, the Colorado Springs Real Estate Market has been less effected. Real Estate is still very much localized. Although Colorado Springs is not exempt from national trends, it has certainly not seen the high levels of foreclosures that other areas have witnessed. If levels of distressed properties rise, the Colorado Springs housing market should be much more insulated that other areas across the country.

Home Affordable Foreclosure Alternatives Program: Overview

If you have had any experience in selling or buying a home, you may have experienced the "Desperate Agent". Easily identified, this agent exposes themselves in many ways.

If you ever get the feeling the agent needs you more than you need them them, you may be dealing with a desperate agent.

If you feel like they try to extend conversations to build rapport, you may be dealing with a desparate agent.

If they lead with "Special offers" like discount fees and rebates, you may be dealing with a desparate agent.

If they sent you "Stuff" which is just like every other agent's stuff, you may be dealing with a desparate agent.

While there is certainly other indicators, one thing is sure, a desperate agent needs a deal to survive. While I will never fault anyone for being aggressive to meet their clients needs, desparation may lead to selling out those needs for self serving objectives. This manifests itself in the negotiation process. If an agent cannot confidently negotiate their value, the ability to negotiate for others is suspect.

Confidence in self value should exude from the agent at the very moment you meet them. Their ability to communicate confidence both verbally and in body language should be obvious.

Certainly you can sense when some one is not confident in their position. In negotiations, the buyer and their agent will sense it too. This will translate into a disadvantage during the negotiation process and will result in selling too low or buying too high.

Negotiations is the art of getting what you want. The agent that you choose must identifiy the viability of your expectations up front and then work diligently to help you achieve them.

Mortgage rates take a turn...for the better!

Although there has been much speculation that rates will rise (and I believe they will) we are currently seeing a drop in which the 30-year fixed-rate mortgage averaged 4.93 percent, down from last week when it averaged 5.00 percent. Last year at this time, the 30-year fixed rate mortgage averaged 4.86 percent so we are close to last year's numbers.

"Interest rates on fixed-rate mortgage declined for the 5th straight week," said Frank Nothaft, Freddie Mac vice president and chief economist. "The National Association of Realtors® reported that median house prices are recovering in more local areas in the latest quarter.."

I appears that we have a great opportunity going into the busy season for home sales.

Obviously this is a sobering number. With that being said, lets take a look at a few things that will help you be one of the "Lucky 13".

Sounds obvious right? If so obvious why only 13%? The facts are that there are plenty of good buyers available and you don't have to sell at "Rock Bottom" pricing to be successful. Strategic Default-a Viable Strategy if Upside Down?

With the Colorado Springs Real Estate Market being down from 2006, does it make sense to simply walk away? Lets take a closer look.

Certainly the vast majority of homeowners who foreclose have no other option. Economic conditions have left them a choice: Either buy groceries and keep the heat on or, pay the mortgage. A simple choice.

On the other hand there is a growing trend of "Strategic Defaults": Where a homeowner simply walks away bacause the debt on the home is greater than the value. Recent studies show that approximately 1 out of 4 foreclosures fit in this category.

While some may advocate this strategy, there are pitfalls: Credit rating will be impacted and the ability to buy again may not become a reality for as long as 7 years or more.The possibility of the bank filing a judgement, especially in those cases where the owner's income is good, is possible. You leave yourself at the mercy of the rental market. Risk of rising rents is a real possibility due to increasing demand because of tougher loan qualification guidelines, more former homeowners needing housing and the possibility of increasing interest rates.

Although real estate prices have dropped substantially, historically speaking, they have always come back. There is no reason to believe that they won't again. A "Strategic Default" may be viewed as the same as selling at the bottom of the stock market.

Other options to a "Strategic Default" may be: Simply staying and riding it out, renting it or a loan modification. Certainly, when looking back, there will be sense of gratification in knowing you survived the tough times and made good on your mortgage commitment.

As Expected.....!

Ok so I called it, offers are way up on Colorado Springs Real Estate as the deadline for the Housing Tax Credit approaches. Furthermore, it seems that the offers are a bit lower in an attempt to get sellers to "Bite" on a lower offer because this is the last week for the tax credit.

In my opinion this is a good strategy. Many sellers have hung their hat on the tax credit in hopes the demand will increase the chances their home will sell for money. With the deadline approaching, some sellers may in-fact take a lower offer in an "Last gasp" attempt to sell befoore the tax credit expires.

With 3 days left my recommendation...make an offer to get the negotiation process rolling. Have a few houses in mind and move quickly through the process and move on to the next one if it doesn't work out. There is still time to get the right deal and also benefit fron the additional incentive.

Higher Interest Rates a Certainty?

Mortgage rated ARE expected to increase from the long-time historic lows. We have all been a little spoiled by these rates as they have become the "Norm". I laugh when I say this, I swore I wouldn't but, "Back when I was a kid" in the 80's and even early 90's an 8% rate was a teriffic rate!

Fast forward to today with some rates were seen in the 4% range and low 5%'s were common, the "sticker shock" will be tremendous.

Even more crucial to the Colorado Springs real estate market is the effect we will see from the predicted increase: Lower affordability index and reduced real estate prices.

As rates move upward, prices will go down. Real estate, being supply and demand driven, will experience less buyers which will qualify for a certain price range of a home. As a general rule, for every 1% increase in rates, there is a 10% decrease in affordability. Resulting impact will be seen as less buyers causing prices to slip and those in the market to buy being able to afford less!

According to Real Estate.com, the Top 10 Home Buying Mistakes are:

1. Doing it alone. Buying a house is a complex transaction. Even if you don’t use an agent, you’ll need a complete, dependable team: lender, lawyer, inspector, insurer, as well as referrals and advice from friends and family. Enlist the help of these individuals early in the buying process.

2. Buying at first sight. You may be in love with the place, but does it fit your family’s needs and budget? Make a list of your needs and wants and make sure the house fits your requirements. Check out the neighborhood and the community before you buy by visiting at different times of the day and week to learn about noise and traffic patterns. Even if you don’t have kids, check out the local schools to make sure your resale value will be good.

3. Not getting pre-qualified and pre-approved. Being pre-qualified gives you a general idea of how much you can afford to borrow. Being pre-approved means a lender has verified your information and credit rating and agreed to provide you with a specific amount of money. You are in a better position to go house hunting knowing exactly how much you can afford and that you have financing.

4. Overbuying. You may qualify to borrow more, but can you afford to? Analyze your monthly costs: debt, food, transportation, entertainment, and savings. As a general rule, your total monthly debts, including your mortgage, should not exceed 36 percent of your income before taxes. Be sure to budget enough to cover closing costs (often two to five percent of the home’s purchase price), plus moving, redecorating and maintenance. Allow for increases in ongoing expenses such as utilities and taxes.

5. Misplacing your trust. No matter how much you like the agent, sellers, inspector, or the guy down the block who vouches for them, remember this is a business transaction. Your decision is binding. Do your own research and know your support team’s roles and responsibilities.

6. Relying on oral agreements. Get it right and get it in writing. Written agreements almost always trump oral ones when it comes to contracts. If the offer says the lawnmower is negotiable, but the agent says it’s included, get it in writing.

7. Skipping the fine print. You need to understand what you’re signing before you pick up a pen. Ask for documents in advance, make time to read them and ask questions. Get copies of your mortgage papers a few days ahead of closing.

8. Forgetting or betting on resale. Avoid buying a home that costs 50 percent more than neighboring homes and think before buying the most expensive home on the block. Your neighbors’ lower home values will weaken yours. Remember, markets change. If you buy intending to flip your investment and the market falls and you have to sell, your selling price may not be enough to even cover your mortgage.

9. Making an unconditional offer. Protect yourself with at least two of these contingencies in your offer:

Mortgage financing -- You’re pre-approved, but is the house? Before a bank will lend you money, it will want a formal appraisal of the property to confirm that there is sufficient equity in it to warrant the loan. If the house appraises lower than the sales price, the loan may be declined.
Inspection -- never buy an existing or new home without a thorough home inspection. Walk through the home with the inspector to learn more about the house and any concerns he or she may have.
Insurance -- confirm you can get adequate coverage. In some areas, it’s difficult to get hazard insurance.

10. Having buyer’s remorse. No place is perfect. There will always be surprises. Don’t let a few initial blips spoil the whole ride. And don’t miss a great house waiting for the perfect one!

Colorado Springs Real Estate Market Statistics for 4/19/2010

It is rare to have economic data that is positive on all fronts. When comparing the first quarter of 2009 to the first quarter of 2010 we find increases in the number of sales average sales price, and median sales price. Number of residential sales increased 19%. Average price increased 2.6%. Median sales price increased 2.8%. We find decreases in the number of foreclosures and months of inventory. The number of homes going into foreclosure decreased 6%. Months of inventory decreased 20%.

Thinking about selling your house "In the future"? Take a look at HR 2454 (Cap and Trade bill)! Nevermind the political implications, should this bill pass, the practical ramifications will be staggering!

Contained in the bill are provisions which will REQUIRE certain energy and water efficiency standards to be met before you can sell your home.

In effect, this bill prevents you from selling your home without the permission of an EPA administrator. To get this permission, you will have to have the energy efficiency of your home measured. Then you could be required to make modifications under the retrofit provisions and comply with new energy and water efficiency requirements. Then you get a "Label" posted on your home and if you don't get a high enough rating, you can't sell.

Rising Interest Rates' Impact on Real Estate

Predictions of rising Mortgage Interest rates may impact the Colorado Springs Real Estate market.

Industry experts are forecasting rates to increase to 6% or higher by years' end. Each increase of 1 percentage point in rates adds as much as 15 percent to the total cost of a home. Example: A $200,000 mortgage at 5.5% is $1135 and at 6.5% is $1264 P+I, a difference of $129 and an 11% increase in payments

It is unlikely that Mortgage rates will go down because of the massive sell off in bonds, the ceasing of the government's $1.25 trillion mortgage debt buy-out and the massive national debt accumulating to record levels.

We are starting to see the effects of rising rates here in Colorado Springs. In the last week or so rates have risen considerably moving upward from around 5% to 5.3%. A considerable increase over a short time horizon.

Interest rates are a big risk to the Colorado Springs Real Estate Market. For potential Home Buyers and Home Sellers, "Holding off" may end up costing thousands of extra dollars each years and, in many cases make a new purchase unaffordable.

Today's rates are historically low. Increased rates will put pressure on the entire economy. Six months from now less buyers may be able to qualify.

Deployed Military Personnel Get 1 Year Extension on Tax Credit

Normal Home Buyer Tax Credit deadlines are April 30 to be Under Contract and Closed by June 30 of 2010.

However for qualified service members who are ordered on a period of official extended duty, these dates are extended for one year.

For these home buyers, the tax credit applies to sales with a binding sales contract in place on or before April 30, 2011 and closed by June 30, 2011.
A person who is forced to return to the U.S. for medical reasons before completing an assignment of at least 90 days of qualified official extended duty outside of the United States may qualify for the one-year extension.

Days of record low mortgage interest rates over?

The average mortgage interest rate in the Colorado Springs Real Estate Market increased substantially over the last week, moving up fron below 5% to 5.3%. Rising mortgage rates impacts a buyers purchasing power for Colorado Springs Real Estate and reduces the pool of would-be buyers.

It's all about affordability. Genreally, for every 1 point increase in mortgage rates a buyer's purchasing power is reduced by about 10 percent. For every 1 percentage point rise in rates, 300,000 to 400,000 would-be buyers are priced out of the market in a given year, according to the National Association of Realtors.

For Colorado Springs Home Sellers, putting their homes on the market this spring, rising rates may actually be a good thing. Buyers are racing to complete their purchases and lock in loans before the go up much more. Home buyers, in the short term, will be less likely to worry about a few thousand dollars in the negotiations and be more focused on locking in a reasonable rate.

Health Care May Effect Your Interest Rate

Far fetched- not really. There is an inverse relationship between Bond Prices and Interest Rates.

As our illustrious government spends us into oblivion, there is much talk of the USA loosing it's AAA credit rating; however even if we maintain it, our national debt is mounting as program after program, entitlement after entitlement and earmark after earmark is added on.

Rising debt means rising risk which, in-turn, pushes bond prices down to increase their yields to compensate for additional risk. As bond prices go down, rates go up and we are seeing them creep up ever-so-slightly.

"Interest rates for fixed mortgages rose this week following a run up in long-term bond yields, while ARM rates eased slightly," said Frank Nothaft, Freddie Mac vice president and chief economist. "Rates on 30-year fixed loans were the highest since the starting week of this year."

If you are speculating on the right time to purchase a home, interest rates should weigh heavy in your equation. Certainly as rates rise, affordability drops.

Have you ever seen a property for sale that the price seems too good to be true? You then rush to call your Agent to go see it and make an offer as quickly as possible. You wait and wait for a response only to find out that there is multiple offers! The excitement you felt about getting a teriffic bargain has turned to disappointment beacuse you have been out-bid.

You have just experienced a sales strategy known as "Under Pricing". Becoming more common, designed to produce multiple offers and thereby putting the seller in control of the negotiations, many Colorado Springs home buyers have experienced this scenario.

In the Colorado Springs Real Estate Market, Under Pricing is becoming more and more common. You may see the obvious "One Dollar" listing, which is a huge red flag, as no one is going to sell a property for a dollar, or the more covert Under Pricing where a property may be priced 10% or more below market.

Certainly, I am not saying that all homes with an attractive price are a purposeful attempt to Under Price, however understanding the intentions of the seller and their agent is essential. Experience has proven that there are certain local agents who rely on this strategy as a staple of their business.

When looking for a home, you very well may want to try your hand at these types of homes. Certainly that is your option as a consumer. I am an advocate of informing the buyer upfront when an Under Pricing strategy may be in-play. Knowing this up-front will help you avoid any future disappointment should you be out-bid.

Negotiations- A sense of fair play is crucial

Negotiation Defined

1. General: Bargaining (give and take) process between two or more parties (each with its own aims, needs, and viewpoints) seeking to discover a common ground and reach an agreement to settle a matter of mutual concern or resolve a conflict.

2. Trading: Process by which a negotiable instrument is transferred from one party (transferor) to another (transferee) by endorsement or delivery. The transferee takes the instrument in good faith, for value, and without notice of any defect in the title of the transferor, and obtains an indefeasible title.

In my opinion, when negotiating the purchase or sale of Colorado Springs real estate a sense of fair play and a "Win-Win" scenario is always preferrable to a "Win-Lose" scenario.

Knowing points of importance and having an up-front strategy is crucial. If negotiating price determine which properties will likely produce the desired result. There is no sense in attempting negotiations with a seller who is at market value to try to steal their property way below market. Target those properties which stand to BENEFIT from an offer is price driven. A seller who benefits from a sale where the price may be low, is more likely to be open to this type of negotiations. Possible types of properties are: Short Sales, Fixer Uppers, Bank Owned and HUD homes.

Conversely, when selling, power of negotiations start with a reasonable asking price for your home. Your price must be compared to features and benefits which, when matched against price, provide a reasonable VALUE EQUATION. There are plenty of "Willing and able" Buyers who will chose your home, even at a higher price, if your VALUE EQUATION is correct.

A sense of fair play is crucial on either side. Most folks are not well versed in negotiation strategies. Opening negotiations with a scenario that will offend the other side and cause them "Dig their heel in" removes any flexibility they may have and drastically reduce the chances of moving forward.

Also Important for a successful outcome is to deal in factual information. Communicating factual reasons for offers or Counterproposals often leads to a more successful resolution and leaves both parties with a feeling of accomplishment at the end of the day.

In most circumstances, if you strategy is defined up-front and you stick to your plan, satisfaction will be yours.

Dual Agency, Who Benefits? See the Definitions of Working Relationships First!

If you are not familiar with the term DUAL AGENCY, here is the quick definition. A Dual Agent is someone who represents both the Buyer AND the Seller in the same transaction.

In most areas, like Colorado Springs for example, you can not legally be a dual agent in a real estate transaction. You can however be a Transaction Broker. Basically the same idea with different responsibilities.

Q: Who benefits by having only one agent in a real estate transaction?

A: That depends on your point of view!

Let me explain. There are a couple different ways to look at it.

Lets start with the PRO's: (Assuming a competent agent)

My personal opinion is that is it always easier to deal with the other agent when you are the other agent!
Processes are easier, under most circumstances, with only one agent because lines of communication are shorter.
If you have enough "Trust" within the principals and the Broker, the negotiations are more streamline and tasks easiest to accomplish

The CON's for using Transaction Broker

Confidential information may be inadversely communicated to the other party.
Assuming the Broker is not competent, there is no "Other Broker" to push the deal and keep things on track.
There could be failure to disclose pertinent information with no checks and balances.
You never know for sure where the Transaction Broker's loyalties are. They actually have no Fiduciary responsibility to either side.

Certainy, most Colorado Springs Real Estate Brokers have the integrity and competence to be a Transaction Broker. If you are considering a relationship with a Real Estate Broker. They must first show you the form called DEFINITIONS OF WORKING RELATIONSHIPS. Be sure they fully review it with you, make sure you have thorough understanding of what the relationships are and be sure you know how this applies to you.

Colorado Springs Economy on the rise

Ok I've mentioned it before...the Colorado Springs economy, in my opinion is in a good place. Builder Magazine already has the Colorado Springs Real Estate market ranked #14 nationally and now this article from The Gazette (The Local Colorado Springs Newspaper).

The article, written by Bill Radford of the Gazette, says" Another sign of the budding economic recovery, February sales tax collections rose 4.74 percent compared with February 2009, the Colorado Springs Financial and Administrative Services Department reported Monday.

February collections reflect consumer and business purchases made in January. It is the fourth straight month of year-to-year increases..."

Obviously this is more empirical evidence that recovery for Colorado Springs is underway. Furthermore, with tax revenues increasing, a rise in real estate prices will follow. Personally speaking, demand for Colorado Springs real estate is up. On numerous occasions we are seeing multple offers and our sellers are getting close to asking price.

One caveat, watch interest rates! With government spending at a record pace, rising deficits and a huge national debt, interest rates may begin to rise soon. Sage advice: Get now while the gettin is good!

Why being nervous about your Appraisal is a good thing

If you have not heard the news, Colorado Springs Real Estate appraisals have become more conservative with values being scrutinized more often. Ultimately this is a good thing because appraisals, along with loose lending standards of the past, played major roles in unsustainable rise in real estate prices. In days past appraisal were never an issue and homes always mysteriously came in at value.

Fast forward...today, in Colorado Springs appraisers are now being held into account. This means that their reports must be substantiated with solid documented facts on how their opinion of value was determined. Furthermore, underwriters now have the ability to adjust the value downward simply because they disagree with supporting evidence or the property being located within a declining market. This can happen without warning and has the ability to kill the sale. Obviously, during the appraisal process, sellers tend to be nervous because of the uncertainty of obtaining value.

My point of view is this. If you are a seller and looking to maximize your homes value you WANT to be nervous during this process. This is a sure sign that you are getting "TOP DOLLAR" for your home. Your agent should be doing everything ethically possible to squeeze every penny out during the sale.

I might also suggest that (Unless you just want to get your home sold and are not primarily concerned with value) you address this while interviewing an agent to list your home. Be sure that your listing price is based on facts. A good agent should have an understanding of value adjustments that can be substantiated with data and know how to present a reasonable case to obtain this value.

Although communication between appraisers, lenders and Realtors is now more restricted, and it is more inconvenient for everybody involved, these restrictions do help prevent colusion between them. Knowing how to navigate within the boundaries while achieving the highest sales price is now more difficult than ever: and rightfully so. The upside of this inconvenience is consumer confidence and industry professionalism.

The FSBO and the Elephant in the Corner

As a Colorado Springs Real Estate Broker, I speak with hundreds of FSBO's, and like Led Zepplin once said "The song remains the same". On just about every occasion the FSBO's identify the main reason why they are selling their own home-to save the commission. Although the reason is not original, I respect it as their decision, their home and their finances!

The facts indicate that Real Estate commission, while seeming expensive, DOES produce a return on investment. Consider the facts:

It is a statistical fact that the competent agent negotiates a higher sale price than the owner does. The buyer responds differently to the agent than they typically do with the seller.
Buyer of a "FSBO" expects to pay less than the fair market value.
Statistics tell us that only about 3%-4% of home buyers actually buy the home that they called on.
90% of all home buyers use a Real Estate professional
The typical FSBO home sold for $187,200 compared to $247,000 for agent-assisted home sales.
FSBOs accounted for 13% of home sales in 2008
FSBO transactions have a much higher chance of legal disputes

So the "Elephant in the corner" is that the DIY home seller is actually saving the commission. They are not! Facts indicate that they are actually losing money, decreasing the chances of selling, increasing the time it takes to sell and increasing the chances of legal disputes.

Ok, the "Free-bees" just keep rollin in...now you can get free appliances on select homes! Fannie-mae homes are now offering appliances in addition to paying buyer closing cost up to 3.5%.

Also Fannie-mae homes are sold as is, but the word on the street is that they may be willing to do "Some repairs" to accomodate FHA and VA appraisal conditions.

Property Condition Impacts Selling Your Home

Last week we saw 177 HOMES SELL in the Colorado Springs Real Estate market. Not bad numbers, right? Well, certainly a step in the right direction but there were 2974 Active Listings so less than 10% of all homes Listed actually Sold. Also there were 213 New Listings that came on the market for the same week.

Let's look at the positives though. Colorado Springs Homes are selling and the market is turning the corner. In fact, the Colorado Springs Real Estate market was ranked #14 healthiest market for 2010 nationwide by Builder Magazine. Also, short sales are becoming less and less popular by both Buyer and Realtor. This means that "Regular homes" are increasing in popularity.

So, if you want to maximize value you must maximize condition. We have encountered, on recent occasions, multiple offers. That's right I said MULTIPLE OFFERS on homes that were in immaculate condition.

The determining factor fot maximizing value is the condition of the home. You must address the condition in a variety of ways: Lighting, Cleanliness, Accessories, Decor, etc.

Did you know?

With the tax credit you can:

Claim the credit on their 2009 return, even if the purchase is completed after December 31, 2009
File an amended return for 2009 if their purchase is completed after April 15, 2010
Or you can just claim the credit on their 2010 tax returns.

If you decide to apply tax credit to 2009 you will need to:

Fill out Form 5405 to determine the amount of your available credit;
Apply the credit when you file your 2009 tax return or file an amended return;
Attach documentation of purchase to your return or amended return.

I have heard of retroactive taxes before but when has the government ever allowed reatoactive tax credits? Never that I can think of so get while the gettin' is good!

Some personal thoughts about the adversity we all face

So this morning I was getting in my cardio workout in, watching a little news, contemplating what was inspiring me and how this was going to relate to writing a post about Colorado Springs Real Estate. Admittedly so this is a little of topic.

You know how it goes when one thought leads to another? We'll that how it was going for me today while tuned in to America's Newsroom and missing Megyn Kelly. Since I've had this thought before I initially began to ignore it. Then my brain picked up momentum and kicked in overdrive.

Here it is, "As a Country, we are headed in the wrong direction and people are scared". Ok, give me credit for pointing out the obvious! Today though, it hit me that there is something more. (Don't worry I am not going "Conspiracy theory" here), "I am not only concerned about the direction of the Country, I am feeling a bit bewildered because I feel we are like a ship with no rudder and no direction. Furthermore there are millions out there, like me and even worse, they are waiting for the other shoe to drop"....WOW what a moment!

Being both a pragmatist and an optimist I quickly moved myself back to reality and out of the drama! "Sure we have issues. Of course there has been some really scary recent times and probably a few more to come". Again thoughts with direction and momentum, I move even further to: "What must I do to make a difference"?

The answer is the same simple one in which I come back to. Faith. Faith in God, faith in people, faith in this Country faith in myself. Again, thought process in full swing, I try to remember the challenging times in my life. It's funny how that works, I have little memory of the actual challenges themselves but much evidence of the blessings that have come from them. Character, Faith and Family: all stronger!

Speaking confidently, I believe that people are engaged in today's events. The Giant is awake and finally paying attention. Politics aside, for the first time, in a long time, voices are being heard. This is a great time to be an American. Character, Faith and Family are all being restored and their effects will be felt for a long time to come. So today, make a difference simply by having faith, live like an American and continue to press on. We will all be better for it.

Home Prices expected to firm as downward trend of homes available for sale

Nationally there is a trend of decreasing inventory of homes available for sale. Because of this, home prices are seen firming up and are expected to continue to do so. This is especially so in Colorado Springs.

As quoted in Realtor.org on February 26, 2010 “Activity should be picking up strongly in late spring as buyers take advantage of the tax credit, which is critical to absorb distressed properties reaching the market and to continually chip away at inventory,” Lawrence Yun, NAR chief economist, said. “With a downtrend in the number of homes on the market, especially in the lower price ranges, values are beginning to firm but with great variance around the country.”

Colorado Springs Real Estate market has seen an above average return to equilibrium. With multiple offers being seen on real estate that is fairly priced and a reduction of inventory available for sale, I am expecting to see areas like Colorado Springs lead the way for an increase in real estate values.

Obviously there are markets such as Las Vegas where recovery will take longer to recover beacuse they were the hardest hit in the downfall of real estate.

For prudent buyers who have waited out the market, the days of deep deals may be over. It is time to purchase while there are still a few deals available. Once the market shifts back into the seller's favor, you will be at the mercy of the market and suspect to higher interest rates.

The One "Must Have" you must have when buying a Short Sale

So I will use ficticious names to protect the innocent, but March 2009, I listed Jane and Bob's house.

Now, like many sellers in today's Colorado Springs Real Estate market they were upside down, had some important personal issues and HAD to sell. The only viable option - Short Sale it!

Fast forward January 5, 2010 (that's right were talking 10 months later, 3 buyer's walking away due to frustration and details of which iI won't bore you with which happened between) we get a call from the bank: "The contract looks good approval within 2 weeks!" ...Oh yeah!

February 15, after many calls and e-mails with no return I actually LOL'ed (Not really but if you don't laugh, you'll cry!). We escalate the file for the fifth time with no response. Now, Like Rocky Balboa, I have the eye of the tiger! I pick up the phome and dial again.

Finally, I get someone who cares only to find out that the file has been (As they describe it) "On some desk in a back room in Houston for weeks with hundreds of others". Wow, the incompetence of this lender is blinding. Are they really this cavalier when peoples lives and futures are on the line? It must be so, how else can you explain it? Thank God for Nate, he has picked up the ball and is now running full speed with it and making progress.

As of today, we have a preliminary approval with the current buyer. The final details are being worked out and because of the buyer's patience, they have endured and are going to get a good deal on their new home which should be set to close in March 2010.

The one thing that the final buyer had was PATIENCE. They have hung in there and rolled with the punches. Now to be fair, not all deals are like this one but like a famous movie character once said "Short sales are like a box of chocolates, you never know what you get until......."

When considering purchasing a short sale in Colorado Springs often times you will get an idea of what to expect simply by finding out who the lender is and how many loans there are. The lender not mentioned in this story is one of the largest nationwide lenders out there and we all know who they are. They have developed a reputation for themselves and stories like this are not uncommon. However, not all lenders perform the same way. Ask your Broker to do some research before writing an offer on a short sale. The frustration saved will be your own!

Now that we have ripped apart the beauty of distressed sales, lets flip the coin and look at what you must do to compete with them

Strategy to compete against Colorado Springs distressed homes. You MUST!:

Update and clean. A fresh coat of paint (Neutral colors are best but avoid too much white as it looks too sterile), fixing any broken items, cleaning carpets and sprucing up the yard will go a long way. (Any questions on this will be answered to a simple visit to a sales office of a new home subdivision).
Pricing the home to move will create demand. We just received 2 offers on the same day for one of our listings. Now who has the power? Pricing too high puts the power of no squarely with the buyer.
Staging creates the feel of home. Furnished rooms are better than empty ones. Creating a "Wow" factor makes it easy for a buyer to choose your home
Don't overstage. Doing too much like candles, music, cookies may seem impressive to the seller but will most likely be perceived by the buyer as an obvious sales pitch,
Hire an aggressive agent with modern technology. Don't kid yourself, the agent makes the deal. Be sure that their technology is up to date. Like everything else, advertising mediums has a lifecycle. Print is out! SEO, blogs and informational advertising is in. It is where buyer's are seeking useful information to use while making a decision and it is how they will find their next home. Be ahead of the curve, not behind it.
